This Privacy Policy describes how Forescout Technologies, Inc. and its subsidiaries (“Forescout,” “we,” and “our”) collects, uses, and processes personal information about individuals that we collect and process on our website, customer or partner portals, or via communications with you.

Forescout’s Commitment

Forescout is committed to protecting your privacy. We will not share or otherwise disclose your personal information except to provide our service or as otherwise described in this Privacy Policy without first providing you with notice and the opportunity to opt-out.

This Privacy Policy applies to personal information collected and used by Forescout as a “data controller,” “business,” or other equivalent term under applicable data privacy laws. This includes personal information collected from individuals who access our websites or otherwise interact with Forescout’s online services by registering for events or training, attending online webinars, signing up to receive email newsletters, downloading whitepapers, accessing our customer or partner portals, sending us emails, or as otherwise provided to us. It will also apply to our customers, business partners, and vendors when accessing our training, marketing events, learning management systems, or individuals submitting job applications.

If you do not agree with this Privacy Policy, do not access or use our websites or provide us with your personal information.

This Privacy Policy does not apply to any personal information that we process on behalf of our business customers or third parties in the role of a “service provider” or “processor.” We do not control how these organizations collect, use, and share your personal information. If you have questions about the privacy practices of those organizations, please contact them directly.

If you are a Forescout Customer or entity who has entered into a subscription agreement with Forescout (or its authorized partner), and use Forescout services, other privacy disclosures and information apply. Personal Information We Collect and Purposes for Processing

When you visit our websites, we collect personal information in various ways depending on your activities.

  • Automatically Collected Information from Site Visitors: When an individual accesses our websites, we automatically collect information about general uses and patterns. This information includes IP address, device and connection information (including browser type, internet service provider, operating system, and referring/exit pages), site pages and content viewed, interactions on our website, products considered, frequency of visits to our websites, and other information collected by cookies, pixels, and tags.
  • Marketing Requests and Forms: When you manually complete a form to request additional information about our products or subscribe to our marketing emails, training, demos, or webinars we ask for additional information. These forms collect your name, email, company name, job title, phone number, and country.
  • Customer and Partner Portal Logins: If you are accessing Forescout’s Partner Portal or our Customer Support Portal, you will be asked to provide your username and password to access the site. To sign up for access to the Partner or Customer Support Portal Forescout will collect your name, email, company, job title, phone number, address, and country.
  • Learning Management Systems and Training Sites: If you are accessing Forescout provided courseware or training, we collect your IP address, name, email, username, password, education and training history, grade, company name, country, and job title.
  • Job Applicants: If you are applying for a job at Forescout through our website, we will also collect your name, address, work history, contact information, and other personal information that you choose to share with us in the process of applying for a job at Forescout, including sensitive personal information.
  • Third-Party Vendors: Forescout may receive information about you from third parties, including publicly available databases, vendors, partners, or other sources. This information can be provided from online and offline sources. We may combine such information with the information we already have about you. This information is used to determine your suitability for employment, your interest in our products, joint marketing opportunities with our partners, or for other legitimate purposes.

How We Use Personal Information

Forescout uses the collected personal information to provide you with information, special offerings, security alerts, training, requested customer service, improve and update our sites, help Forescout better understand visitors’ needs and interests, and other related business purposes. For example, we use personal information to:

  • Offer access to your Customer or Partner Portal;
  • Set up and administer your account, including identification, authentication, usage monitoring, security, logging, and backups;
  • Identify new customers and schedule and provide requested demos;
  • Provide you with technical and customer support, and enable the provisioning of services, including sending confirmations, invoices, technical notices, updates, security alerts, administrative messages, and troubleshooting;
  • Provide Training and Certifications;
  • Register you for events;
  • Communicate with you and your referrals about promotions, upcoming events, and news about products and services offered by Forescout and our selected partners;
  • Deliver relevant marketing materials and communications to you and determine the effectiveness of our marketing campaigns;
  • Provide and deliver products or services, including software updates and customer service;
  • Manage our organization and its day-to-day business operations;
  • Understand you and your preferences to enhance your experience, including tailoring our advertising, learning courses, and promotions to provide products and services which may be of interest to you;
  • Communicate employee training levels and progress for maximizing purchased products and services;
  • Respond to your comments and questions;
  • Conduct surveys that we use for marketing and quality assurance purposes;
  • Business to business communications;
  • Enforce our legal rights and comply with legal requirements and applicable laws;
  • Prevent, investigate, or provide notice of any fraud, security incident, or unlawful or criminal behavior;
  • Manage job applications;
  • Subscribe you to newsletters, email lists, and other promotional events;
  • Perform site analytics and advertising;
  • Notify you about changes to our sites or obtain any required consent; and
  • To maintain security of our site and improve our sites and services to better meet customers’ needs.

Providing your data is optional in many situations, but it may be necessary for certain services, such as marketing requests, access to Customer or Partner Portals, or to access specific content. In such cases, if you do not provide your information, we may not be able to provide you with the requested services.

Under the GDPR, we process your personal information based on:

  • Legitimate interests – we have a legitimate interest to process personal information from you for security and safety purposes, to detect and prevent fraud, to protect and defend the rights or property of others, to run our business, to provide purchased products and services, and for our own rights and interests. Our interests do not override your interests or fundamental rights and freedoms and you retain the right to object to our processing as further described in the How to Control Your Personal Information section.
  • Consent – Where you have consented to our use of your personal information including if you opt-in to our mailing or call lists, schedule a demo, or if you accept the placement of cookies in accordance with the Forescout Cookie Notice. You may withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  • Contract – we need to process your personal information to answer questions and requests from you when you request additional information, sign up for emails, training, demos, portals, or webinars, or when you submit a job application.
  • Legal Obligations – we may need to process your personal information to comply with relevant laws, regulatory requirements, or to respond to lawful requests, court orders, and legal processes.

Disclosure to Third Parties

Forescout may disclose the personal information we collect about you with third parties for business purposes. Below are categories of third parties that Forescout may provide your personal information to and a description of the purpose behind the disclosure.

  • Our Subsidiaries and Affiliates: To provide 24×7 customer service and products globally, local sales and marketing, and for other business purposes, we may disclose your contact and transactional information to our current or future subsidiaries, which may include parent and subsidiary companies, joint ventures, or other companies under common control, in which case we will require our affiliates to honor this Privacy Policy.
  • Business Partners: Forescout may disclose personal information to its business partners, delivery partners, and suppliers to the extent needed to deliver Forescout products and services or respond to requests for information about products or services or otherwise support your business needs.
  • Third-Party Vendors and Suppliers: Forescout may disclose certain personal information collected on our websites to our service providers for various specific business purposes. We use third parties to provide site-related services. We may provide IP addresses, cookies, and site analytical information to assist us in improving our sites. We may transfer or disclose your personal information for corporate reasons. For example, we may disclose your personal information to third parties in connection with or during negotiation of any merger, financing, acquisition, or similar transaction. We may also share personal information with our auditors, attorneys, or other advisors in connection with our internal corporate functions.
  • Government and Law Enforcement: In certain situations, Forescout may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or other law enforcement requirements, to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud.
  • Marketing Partners: We may disclose your personal information to marketing partners who provide marketing content, campaigns, or communications. We may also share contact information at events or trainings where you have given us your consent to share such information with specific third parties.

How We Protect Your Personal Information

Forescout uses appropriate technical and organizational measures designed to protect personal information from misuse, unauthorized or unlawful access or disclosure, loss, damage, or destruction. These measures include but are not limited to physical access controls, encryption, and internet firewalls. However, you should know that no company, including Forescout, can fully eliminate security risks associated with collecting personal information. We cannot fully guarantee the security of your personal information transmitted to our website. A username and a password may be needed to access certain areas of our websites. It is your responsibility to protect your username and password. If you believe that the security of your account has been compromised, please notify us immediately in accordance with the Contact Forescout section below.

Data Retention

We retain your personal information for as long as reasonably necessary to fulfill the purposes for which it was originally collected unless a longer retention period is required based on applicable law, regulation, and/or professional standards. We retain online account related personal information for as long as your account is active and if you have opted in to receive marketing communications. When we no longer need to retain your personal information, we will remove it from our systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it, unless we need to keep your personal information to comply with legal or regulatory obligations, or to preserve evidence within the statutes of limitation.

For example:

  • We may retain your personal information after you have closed your account so that we can send you information about products, services, and publications we think you may be interested in. You can “unsubscribe” from receiving such messages or tell us you are no longer interested;
  • We may retain your personal information in order to protect our legal rights, or those of third parties, or to comply with the law;
  • We may retain personal information about how you have used our products and services in order to improve and develop our business;
  • If you purchase products or services from us, we may retain your personal information for as long as we need to in order to provide you with customer service, or for compliance purposes, for example, in order to comply with our record-keeping requirements; and
  • If you have applied for a job with Forescout, we may retain your resume and contact information for future job openings.

How Forescout Uses Cookies and Tracking Information

Forescout’s websites use cookies, tags, and web beacons for different purposes, including providing you information based on your browsing preferences, regional and geographical preferences, and saving your settings.

  • Cookies: Small pieces of data stored on the user’s computer by the web browser or websites while browsing a website. For more information on the use of cookies on our sites, please read our Cookie Notice.
  • Tags: A website tag is a tool used to gather data on a website. This tag can be code, a pixel, or an image that enables our sites to collect information about a person and on-site behavior across our sites.
  • Web beacons: These picture files are used to keep track of your navigation through our sites. This allows us to understand who is visiting our sites and are used by third parties to help monitor traffic.

Forescout may collect analytics data or use third-party analytics tools such as Google Analytics to help us measure traffic and usage trends for our websites and to understand more about the demographics of our users. You can opt-out of any analytics by setting your browser settings or by going to Forescout’s Cookie Preference Center and opting out of targeting cookies.

Do Not Track

There are different ways you can prevent tracking of your online activity, including but not limited to setting a preference in your browser that can alert websites you visit to not collect information about you (‘Do-Not-Track’ or DNT signal). Depending on your device and operating system, you may also be able to set Global Privacy Controls. Forescout cannot guarantee that our sites recognize Do Not Track Signals from your internet browser. However, you can go to the Cookie Preference Center to set your cookie choices for our sites.

We may use third-party companies and individuals to provide services for our sites e.g., to manage our advertising on other sites, to perform web analytics, to conduct marketing activities on our behalf, and to improve our sites’ features. Such third parties may use cookies or similar technologies in order to provide you advertising based upon your browsing activities and interests on other websites. Forescout does not exercise control over third-party websites and this Privacy Policy only addresses Forescout’s use and disclosure of personal information collected from our sites.

If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here (or if located in the European Union, click here). Please note this does not opt you out of being served ads. You will continue to receive generic ads.

How to Control your Personal Information

Forescout allows you to control your personal information through multiple means.

You may access, correct, or request deletion of your personal information by logging into your account or submitting general requests to [email protected] or our Data Subject Request Portal. We will respond to your request within a reasonable timeframe.

Your Rights to Your Personal Information

You have certain rights in your personal information, subject to local data protection laws, including:

  • Right to Access: you have the right to confirm whether or not personal information about you is being processed, request the categories of personal information processed, request access to your personal information, and to receive a copy of the information we hold about you;
  • Right to Correction: you have the right to correct inaccurate or incomplete personal information that we hold about you.
  • Right to Deletion: you have the right to ask us, in certain situations, to delete or remove personal information where there is no good reason for us to continue to process it.
  • Right to Portability: you have the right to request a copy of the personal information you have provided to us in a structured, commonly used, machine readable format, or to request transfer of your personal information to a third-party provider of services.
  • Right to Restrict Processing: The right to request that the processing of your data is restricted. This enables you to ask us to suspend or restrict the processing of your data to only those uses or processes which you consent.
  • Right to Withdraw Consent: the right to withdraw your consent if you have previously provided us with your consent to process your personal information and we rely on it as our legal basis for processing. This will not affect any processing we had undertaken previously based on your consent.
  • Right to Object to Processing: The right to object to the processing of your data, where we are processing it to meet our public tasks or legitimate interests (or the legitimate interests of a third party). Additionally, Forescout will consider your valid objection to the processing of your personal information (including the right to object to processing on grounds relating to your particular situation where we are relying on our legitimate interests as a legal basis for processing your personal information).
  • Right Not to be Subject to Automated Decision-Making: In certain jurisdictions including California, you have the right not to be subject to automated decision-making, including profiling, which produces legal effects. Forescout does not currently engage in any Automated Decision-Making on our website or in our products and services that would produce any legal effect.

Residents of the European Economic Area may have additional rights including to lodge a complaint with a supervisory authority.

Please note that if you opt out but are a current customer, we will still send you transactional emails. Transactional emails are necessary communications about your accounts and our business dealings with you, such as renewals and updates, and, as allowed by applicable law, requests for your participation in surveys. Additionally, we will also retain the information necessary for you to enter our customer or partner portals.

If, in the future, we use your personal information in a way that is not described in this Privacy Policy, we will disclose this to you. At that time, you can choose not to allow us to use your personal information for any purpose that is incompatible with the purposes for which we originally collected it or subsequently obtained your consent. If you choose to limit the ways we can use your personal information, some or all of our services may not be available to you.

You may have the right to appeal a decision we make regarding the exercise of your privacy rights. You may submit your appeal to our Data Subject Request Portal by filing a complaint.

International Data Transfers

Forescout is a global organization and may transfer your personal information to the United States or other jurisdictions outside that where you live, and to our subsidiaries and service providers worldwide. The transfer of your personal information to the United States is necessary for us to provide our websites and services as Forescout is headquartered in the United States. If you do not wish to have your personal information transferred to the United States, do not initiate such transfers by using or submitting information through our sites.

For residents of the European Economic Area, the United Kingdom and Switzerland we rely on the EU-U.S. Data Privacy Framework, the UK Extension of the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework for the transfer of personal information to the United States. For Data Transfers to other countries without Data Adequacy decisions, Forescout will continue to rely on the Standard Contractual Clauses to assure adequate protection of personal information. Forescout has undertaken a Transfer Impact Assessment to document compliance with EU Data Protection Regulations.

EU-U.S. Data Privacy Framework

Forescout Technologies, Inc. and Forescout Government Solutions, LLC comply with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Forescout has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal information received from the European Union in reliance on the EU-U.S. DPF, and from the United Kingdom in reliance on the UK Extension to the EU-U.S. DPF. Forescout has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal information received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this Privacy Policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Forescout commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU, UK, or Swiss individuals with inquiries or complaints regarding our handling of personal information received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF should first contact Forescout at [email protected].

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, Forescout commits to cooperate and comply, respectively, with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal information received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

The Federal Trade Commission has jurisdiction over Forescout’s compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

Under certain conditions, more fully described on the Data Privacy Framework website at https://www.dataprivacyframework.gov/s/article/ANNEX-I-introduction-dpf?tabset-35584=2, you may be entitled to invoke binding arbitration for complaints regarding Data Privacy Framework compliance when other dispute resolutions mechanisms have been exhausted.

Forescout is responsible for the processing of personal information it receives, under the applicable Data Privacy Framework, and subsequently transfers to a third party acting as an agent on its behalf. Forescout complies with the Data Privacy Framework Principles for all onward transfers of personal information from the EU, UK, and Switzerland, including the onward transfer liability provisions.

Where the Data Privacy Framework does not apply, Forescout will continue to rely on other transfer mechanisms including the Standard Contractual Clauses as approved by the European Commission as offering sufficient safeguards as it relates to data protection for data transfers from the EU. Forescout’s standard Data Processing Addendum (for customers), inclusive of SCCs, is available at www.forescout.com/legal.

Children

Our sites and business are not directed to children under the age of 18, nor do we knowingly collect personal information from children under the age of 18. If we learn that we have collected any personal information from children under 18, we will take steps to promptly delete such information. Dispute Resolution and Enforcement

Forescout will investigate and attempt to resolve all disputes and complaints regarding our use and disclosure of Personal Information in accordance with this Privacy Policy.

If you are a resident of the European Union and your concern with Forescout has not been addressed satisfactorily, or if you believe we are not processing your personal information in accordance with applicable law or in accordance with this Privacy Policy, you have the right to file a complaint with the Data Protection Authority in the member state in which you reside.

Depending on where you live and the applicable privacy laws, you may also have the right to lodge a complaint with your national Data Protection Authority or equivalent regulatory body.

Additional California Privacy Disclosures

Under the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 (collectively “CCPA”), and any subsequent regulations, legislation or amendments, California residents are entitled to the following additional disclosers about our data processing. Information Sold or Shared by Forescout

Under the CCPA, Forescout’s disclosure of some internet and other related network activity data including IP addresses, browsing, and device information via cookies may be considered “sharing” of personal information. We share this information for our business purposes with third parties as disclosed above. Forescout does not sell personal information, as that term is defined under the CCPA.

For purposes of the CCPA in the last 12 months we have shared internet and other network related activity information related to our website users through the targeting cookies hosted on our website, including to analytic and advertising partners. You may exercise your right to opt-out of such sharing by clicking on our cookie banner and selecting “Do Not Sell or Share My Personal Information,” or by submitting an “opt out” request through our Data Subject Request Portal. In addition, if your device or browser has enabled Global Privacy Controls, we will automatically receive and honor that preference signal as a request to opt out of our “sharing” of your personal information.

Forescout does not have actual knowledge that we sell or share personal information of individuals under the age of 16.

Sensitive Information

Forescout does not collect, use, or disclose Sensitive Personal Information about you for any purposes not allowed under the CCPA. If Sensitive Information is collected, you will be notified at collection of the specific purpose for which it is collected, and sensitive personal information will only be used for that purpose.
